TERMS AND CONDITIONS

Hey Sisters, welcome to Dress Me Studio! This Terms of Service Agreement is between Dress Me Studio, Inc. (“Us”, “We”, “our” or “Dress Me Studio”) and you (“you” or “your”) and governs your access to and use of our website located at dressmestudio.com.au.

It is required you review all these terms and conditions carefully; by accessing/using any of the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. By accepting these Terms, you signify that you are an individual of legal age (18years+) to form a binding contract, as these Terms are a legally binding contract between us and you.

We, Dress Me Studio, at our sole discretion reserve the right to change these Terms at any time.

At our sole discretion, we reserve the right to limit, cancel or prohibit the use of the Services for any reason, including but not limited to availability and geographic concerns, or if we suspect you are using the Services for any reason that violates these Terms or any additional terms such as fraudulent activity or commercial purposes.

BY ACCESSING AND USING THE SITE OR SERVICE, OR BY PURCHASING ANY OF OUR MEMBERSHIPS, YOU ACKNOWLEDGE AND AGREE TO ABIDE BY THESE TERMS AND CONDITIONS. YOUR ACCEPTANCE OF THESE TERMS CONSTITUTES A BINDING AGREEMENT BETWEEN YOU AND DRESS ME STUDIO, INCLUDING ANY UPDATES OR MODIFICATIONS THAT MAY BE MADE BY DRESS ME STUDIO PERIODICALLY.

Your Responsibility  

You promise to provide us with you most up-to-date, accurate and complete information and always update such information.  You are responsible for providing us with your full name, current email address, mobile number, postal/residential address, and bank card details when you create a Dress Me Studio Account. If there are any changes to the above information you are to update your account to reflect these changes. You may only register one account per Paid Service, and you may not transfer your account to anyone else. 

You must protect the security of your account and other access tools and credentials. Do not share your account with anyone, this includes your Dress Me Studio User ID and Password. Any activity associated with your account, you and only you are solely responsible; including charges incurred from the use of the Services with your Account. 

The Services and Products made available, may only be used by you for your own personal use and in a way that complies with all laws that apply to you. You may not use our Services and Products for commercial use or on behalf of or for the benefit of a third party. Any use of services and/ or Products that violates these Terms, or any additional terms and applicable law, you are solely responsible for. 

GENERAL TERMS

Hire Periods

Dress Me Studio hire periods are a 72-hour period. The product/s must be returned on or prior to the 72 hours from hire, either via drop off to our Moone Ponds Studio; or via our Chosen Delivery Partner. 
We may but are not required to extend your hire period for a Product at your request. This will be subject to Product availability and prepayment required for any additional fees applicable to the extension time of the Product. Failure to return a product by the agreed date is a violation of our Terms and will result in us charging your Payment Method for Late Fees up to the maximum Late Fee, terminate your account, and/or take legal action. 

Should you want to request a hire extension please get in touch with us directly via email or in store. Extension Fees will apply.

Pickups & Drop-offs

Pick Up is available from our Moonee Ponds Studio (Refer to our home page for address and opening hours). Your product will be ready for Pick Up from your nominated booking date. You are responsible for arranging Product Pick Up within our business operating hours. If pickup is required outside our business hours then you must request this directly from us and it will be to our discretion if this time will be acceptable. You acknowledge that the return date will not be extended if you are to pick up the product late, unless otherwise agreed upon by Dress Me Studio. 

You agree to return each product to us by the agreed return date which is 48 hours from your selected hire date unless other arrangements have been agreed to by Dress Me Studio. Drop Off Returns  are to be made via Drop Off to our Moonee Ponds Studio and can be made within business hours to our front desk or outside of business hours by dropping it in our drop off box located at the front of our Moone Ponds Studio.  

Deliveries & Returns

 You are responsible for providing us with accurate and up-to-date shipping information for deliveries at all times.  If you provide us with an invalid shipping address or where you cannot securely accept products upon delivery, you are solely responsible for any theft, loss, or damage to the Product/s.

 Dress Me Studio will not be held responsible for any theft, loss, damage to the product or/and for any fees or expenses that you may incur if the product isn’t returned on time. We do not ship Products outside of Australian State Victoria, and you may not return Products to us from outside of the Australian State of Victoria without our prior written permission. 

All delivery and return shipping fees are an additional cost to you and Dress Me Studio pricing does not include this any pricing of our stocked items.

If you misplace or damage the return satchel provided by us, you are responsible for organising your own return packaging for the Product, at your own expense. Furthermore, you acknowledge that Dress Me Studio will not be liable for any delivery delays and additional delivery fees that result from you using a different carrier and/or Return Packaging. You will be solely liable for all such delays, associated fees (Late fees and additional delivery fees) and any damage to Products. You must use the shipping carrier specified on the return label included in the pre-paid return satchel. Any products sent back to us using a different carrier,

Late Fees 

You acknowledge that if you do not return one or more Products by the scheduled Return Date, you herby authorise Dress Me Studio to charge your Payment Method for all accumulated Late Fees, up to the maximum Late Fees and any additional fees associated with future bookings that are affected by the late Return of the Product. These Fees are non-refundable. 

Dress Me Studio late fees will be charged at 50% of the One Time Hire Cost per Day. 

Cancellation Fees

Should you request a cancellation of a booked clothing item within 48 hours of making booking and over 2 weeks out from the booking date then you may email us to request a cancellation.

Contact made after 48 hours of making your booking but with booking start date not within 2 weeks time may result in us issuing store credit.

Contact after 48 hours and within 2 weeks of the booking start date will be reviewed on a case by case basis, but we are under no obligation to issue a store credit as this may have impacted other customer booking this item.

Try on appointment cancellations non refundable.

Product Quality

We aim to provide you with good and fair quality rentals. There may be item imperfections due to items being hired out / worn prior to you. 

Damages/Item Loss 

Should you damage an item, misplace it or it is stolen from you; you are responsible for contacting Dress Me Studio immediately via Info@dressmestudio.com.au. You will be liable to pay any costs involved in repairing the hired item or the RRP cost of the dress if its irreparable or lost due to being misplaced/theft. Hiring via subscription or one-time-hire with Dress Me Studio means you accept the terms & conditions and herby authorise Dress Me Studio to charge your Payment Method for these fees should they be incurred.

Try On’s

You are responsible for attending your Try On appointment on time. Try Ons are booked via our Try On calendar on our website and are allocated a 30-minute session. At our discretion we may limit or deny your Try On booking if you have previously cancelled or unattended a booked Try On appointment.  This may affect other customers opportunity to Try On, you agree to provide at minimum a 3-hour notice of any cancellation or change of time booked.  

For Non-Members there is a booking fee which is non refundable.

Shipping

All pricing and points are valid to use for pickup and drop off only to and from our Moonee Ponds Studio. If shipping is required this fee will be added on if selected at the checkout.

Dress Me Studio is not responsible for any possible delay that may occur in shipping and transit.

Delays

Dress Me Studio is not responsible for any potential delays, omissions, or inaccuracies within the services, including the content. The services might occasionally be unavailable due to computer equipment maintenance or malfunctions, among other reasons. By using the services, you agree that Dress Me Studio will note be held liable for such delays, omissions, inaccuracies, or unavailability.

Website malfunction

In the event of website malfunctions, including but not limited to technical issues, interruptions, or disruptions, we cannot be held responsible for any inconvenience or loss experienced by users. We strive to maintain the website's functionality; however, we do not guarantee uninterrupted access or warrant that the site will be error-free at all times.

Our Content  

The content provided by us through our services, including materials like graphics, data, articles, text, images, photos, illustrations, and information, alongside specific trademarks, service marks, names, and logos such as Dress Me Studio, collectively constitute “our materials” and “content”. You acknowledge and agree that the content is: i) safeguarded by copyright, ii) governed by various intellectual property and proprietary rights and laws, and iii) owned by us, our suppliers, and licensors. Without our prior written permission, Dress Me Studio content cannot be copied, republished, replicated, posted, modified, sold, offered for sale, transmitted, redistributed, or used in any way.

You confirm, guarantee, and agree not to post, share, store, upload, provide, or otherwise make obtainable any user Submission. You will interact with the services in a way which: 

You ensure not to violate the intellectual property rights of any party, including Dress Me Studio 

You agree not to breach any laws, rules, regulations, including privacy or export control laws.

You pledge not to engage in harmful, deceptive, threatening, defamatory, obscene, or unlawful activities, or activities targeting specific groups based on race, religion, gender, or sexual orientation.

You undertake not to use the services for commercial or unintended purposes specified by Dress Me Studio.

You commit to safeguarding the security of your and others’ Dress Me Studio accounts and not will permit unauthorised access. (e.g. allowing someone other than yourself to access your account).

Consent to Receive Periodic Messages

When utilising our services, you agree to receive messages from us. These may include informative text/email notifications (like updates on your order status, reminders, additional authentication, and other transaction-related details) sent to the phone number and/or email you provided. These messages may be delivered through an automated system. You confirm and guarantee that the phone number and/or email you provide when creating an account belongs to you.

Indemnity

You acknowledge and agree to indemnify and protect Dress Me Studio parties against all claims, liabilities, damages, losses, fees, and expenses arising from various circumstances. These include your use of our services, rented products, user submissions, violations of terms or laws, infringement of third-party rights, and disputes with third parties.

 

This indemnification covers:

- Your access to and use of the services (including any action taken by a third party using your account) and any products rented from us (including any failure to return such products).

- Your user submissions.

- Your violation of these terms or any applicable law, rules, or regulations.

- Your infringement, misappropriation, or other violation of any third-party right, including any intellectual property rights, publicity, confidentiality, property, or privacy right.

- Any dispute or issue between you and any third party, including any service, product, merchant, or other third party.

 

In case of such claim, we will attempt to provide notice to the contact information associated with your account. However, failure to deliver such notice shall not diminish your indemnification obligations.

PRIVACY

Information We Collect

Within this privacy policy, ‘Personal Information’ refers to data that directly identifies an individual, like a person’s name, or information that reasonably enables the identification of an individual indirectly, such as an email address, home address, or mobile phone number. Additionally, it encompasses information directly linked or combined with such identifying details.

 

We gather personal information when individuals utilize our services, including our website. This information can be categorised into two main groups:

Passive Data Collection. This pertains to information automatically gathered from customers while they use our services.

User-Submitted Information: This includes details actively provided by the customers, which may be voluntary or necessary for the utilization of our services. 

 

General Uses of Your Information 

We utilise the information we collect, including personal details about you, for the following purposes:

-Providing our services: Your personal information is utilized to offer our services to you, encompassing:

-Presenting products, information, and tailored content through the services. 

-Processing transactions, any transaction linked to your use of the services (including financial transactions).

-Assisting you in locating a return location based on location or geolocation details that you supply.

-To be responsive to any queries, requests, or difficulties you have.

-Communications and Marketing: We employ your personal information to engage with you and furnish information about Dress Me Studio and marketing partners.

-Developing and improving our services: Your personal information aids us in continuously enhancing our services, business, and operations. This includes:

-Analysing usage or interest in specific features and identifying areas of interest among our customers.

-Compliance, fraud prevention, and Safety: If deemed essential, your personal details may be utilised and disclosed to law enforcement, government authorities, and private parties.

  

Communications from Us

We employ your contact information to communicate with you regarding Dress Me Studio and our marketing partners through the various means:

-Sending marketing emails and/or push notifications containing special promotions, updates, and other relevant marketing content, news, and information that we believe will be of value to you.

-Issuing publications about our services.

-Keeping you informed about services, including status updates for your orders.

-Verifying your identity and personal information for your orders/rentals.

MEMBERSHIP

Policy

We are pleased to offer flexible membership options to our users, which can be cancelled or repurchased at any time. Our memberships are designed to provide continuous value and benefits to our members over the course of their subscription.

However, it is important to note that the intention behind our membership model is not to facilitate intermittent access based on short-term needs or to exploit promotional offers. We encourage our members to maintain their subscriptions to enjoy the full range of benefits we offer.

To ensure the sustainability of our membership program and to foster a fair and beneficial community for all our members, we reserve the right to implement a minimum subscription period. This measure will be considered if we observe patterns of behavior that suggest a member is repeatedly cancelling and repurchasing memberships in a manner that contradicts the intended use and spirit of our program.

Furthermore, we reserve the right to cancel an individual's membership or deny the option to become a member if we determine that such actions are necessary to maintain the integrity of our service and the welfare of our community.

We appreciate your understanding and cooperation in adhering to these principles, which are designed to ensure a valuable and enjoyable experience for all our members.

Payment

You are responsible for keeping valid and up-to-date billing and contact information on your account You authorise Dress Me Studio to charge your payment card or other Payment Method for the membership fee when you sign up. This fee will be charged immediately upon your membership order. In addition, you authorise Dress Me Studio to charge your Payment Method for any Late Fees, Additional Fees and/or damage Fees that you are responsible for. 

 

Subscription

Dress Me Studio offer Subscription Paid Services, which consists of an initial one month period for which an initial charge will occur, followed by ongoing monthly charges as agreed by you when you sign up for the Membership Services. The Initial charge date will be your ‘Billing Date’ for all future charges. Your selected Payment Method will be automatically charged the then-current rate on the ‘Billing Date’ until you cancel your Membership. All members will be billed monthly. We reserve the right to change/increase the monthly subscription rate for future billing periods and we will notify you of these changes by sending you an email to the email address associated with your account. 

  

Cancellation

At any time, you may Cancel your Membership Service by contacting us.  All products in your possession must be returned to Dress Me Studio prior to the cancellation of your membership.
Any rental credits accumulated on your account will be voided once your membership is cancelled. These points are non-refundable and cannot be transferred to another user account or transferred to the re-opening of the same account at a later date. 

In the case your payment method is cancelled for any reason (such as loss or theft) or if there's a suspected security breach involving unauthorised use or disclosure of your user ID or password, it's crucial to promptly notify us and update your payment method in your account settings. Failure to provide necessary information or keep it up-to-date implies your agreement for us to continue charging any payment method you have on file for the use of paid services under your billing account. This continues unless you have cancelled the services or terminated your account as per these Terms.

 

Free Trials and Promotions

Any promotional or free trial service offering access to a paid service must be utilised within the specified trial period. Upon completion of your free trial or promotion, you’ll automatically be enrolled to use the relevant paid service and charged accordingly, as per these terms, unless you cancel the paid service in accordance with these terms. Cancellation must be made prior to the end of the trial/promotion period should you not want to continue to use the service.  

Kindly note that the payment terms you encounter while using or signing up for a free trial or other promotion are included as part of these terms.

Rollover points

In the event a rental credit is not used in any given month, it will accumulate until it is used at a later date or the membership is terminated. If you chose to cancel your membership all credits will be voided.

These credits are non-transferable into any other form of payment and/or any other members account.

 

Additional Hires

Members of our service have the exclusive benefit of receiving a set discount off the one-time hire price when renting an additional item after exhausting all rental credits. The discount amount is the one outlined in your chosen plan. This offer allows members to enjoy the convenience and variety of multiple rentals, enhancing their experience with our collection at an exceptional value. This discount is applicable to the one time hire price of the item(s).

 

Pick Stock

Members have Exclusive access to our ‘Pick Stock’ this is a Members only page where Our members can Vote for what they want to have become available to hire from Dress Me Studio. Dress Me Studio does not guarantee to stock an item that a member voted for. Dress Me Studio uses the information from these votes to our discretion. If an item voted yes for by a member is stocked, Dress Me Studio Does not guarantee that the item will be available on the requested dates of the member.

Partner Store Discounts

As part of our partnership program, we facilitate exclusive discounts to our clients from select partner stores. However, we are not responsible for the services provided by these stores. The discounts are offered by the partner stores upon mentioning our business at the time of payment or through a code provided for online orders. We cannot be held liable if a discount is not applied, or if a member is dissatisfied with the services received. If a discount is not applied, we encourage clients to address the issue directly with the partner store. Additionally, please notify us via email or phone so we can investigate the matter and ensure all terms are being followed.

Partner store availability and discounts may change at any time without notice, so clients should verify the latest information before purchasing. Discounts are only applicable to active members, and we reserve the right to verify membership status with partner stores to ensure eligibility. Our partner stores may also conduct routine checks and inform us of clients using their services to confirm their active membership status. Discounts are non-transferable and may not be resold or shared with non-members.

It is the responsibility of the client to conduct their own due diligence before using any partner store's services, including verifying availability, terms, and conditions. We are not responsible for any service issues, pricing discrepancies, or product availability at partner stores.

If a former member attempts to claim a discount under false pretenses (e.g., fraudulently presenting themselves as an active member), we reserve the right to pursue legal action to protect the integrity of our program.

Availability

Availability of our stock for rental on specific dates cannot be guaranteed. We operate on a first-come, first-serve-basis, and therefore, we cannot ensure the availability of specific items for rental on any given date, as bookings are subject to prior reservations by other customers.
